1. Agreement and service operator
These Terms of Use (“Terms”) are a binding agreement between you and Foubeez, the operator of the Foubeez mobile applications, website, APIs, marketplace, advertising tools, wallet, messaging, and related services (together, the “Service”). By creating an account, selecting the acceptance box, or using the Service, you agree to these Terms and the Privacy Policy. If you do not agree, do not create an account or use the Service. You can contact Foubeez through the in-app Help Center or the contact method published on the Foubeez website.
2. Eligibility
You must be at least 13 years old and at least the minimum digital-consent age required in your country. If you are under the age of legal majority, a parent or legal guardian must approve your use where required. Selling products, purchasing or managing advertising, adding or sending wallet funds, receiving seller proceeds, and requesting withdrawals are available only to users who are at least 18 years old and have reached the legal age of majority in their country. The Service is not directed to children under 13. You may not use the Service if the law prohibits you from doing so, if we previously disabled your account for a serious violation, or if sanctions or trade laws prevent us from serving you.
3. Your account and security
Provide accurate and current registration, profile, seller, payment, and verification information. Keep your password, device, recovery methods, PIN, and biometric access secure. You are responsible for activity performed through your account unless you promptly report unauthorized access. Do not sell, transfer, rent, impersonate, or create accounts through automated or deceptive means. Optional PIN and biometric protection secure access on your device; Foubeez does not receive your biometric template.
4. Content ownership and licence
You retain ownership of photos, videos, audio, captions, comments, stories, reels, messages, product listings, reviews, and other material you submit (“User Content”). You confirm that you have every right and permission needed to submit it.
To operate the Service, you grant Foubeez a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to host, store, cache, reproduce, adapt for technical formats, distribute, display, communicate, and make your User Content available according to your privacy and sharing choices. This licence is only for operating, securing, improving, and promoting the Service. It ends when the content is deleted from active systems, except where another user has lawfully reshared it, it remains in a transaction or conversation record, it is retained in a limited backup cycle, or retention is required for safety, disputes, fraud prevention, or law.
5. Community rules and prohibited conduct
You must not create, upload, request, promote, sell, or share:
• child sexual abuse or exploitation material, grooming, sexualization of minors, trafficking, or content that endangers a child;
• non-consensual intimate imagery, sexual violence, exploitation, or instructions facilitating abuse;
• credible threats, terrorism, violent extremism, encouragement of suicide or self-harm, or instructions to cause serious harm;
• hate speech or attacks based on protected characteristics; harassment, bullying, stalking, blackmail, or disclosure of another person’s private information;
• illegal goods or services, weapons where prohibited, controlled drugs, stolen goods, counterfeit goods, fraud, scams, money laundering, gambling where unlawful, or deceptive investment schemes;
• spam, coordinated inauthentic activity, fake engagement, misleading advertising, impersonation, phishing, malware, or content intended to compromise accounts or devices;
• content that infringes copyright, trademark, publicity, privacy, confidentiality, or other rights; or
• any content or conduct that violates applicable law, these Terms, or published Foubeez policies.
You must not scrape or harvest data without permission, reverse engineer protected parts of the Service, bypass rate limits or security controls, misuse reports, access another account, interfere with the Service, or use bots to manipulate reach, views, likes, follows, sales, advertising, wallet balances, or other metrics.
6. Moderation, reports, blocking, and enforcement
Foubeez may use automated signals and human review to detect abuse and may refuse, limit, label, reduce distribution of, preserve, or remove content. Users can report content or accounts and block abusive users. We may warn, restrict features, suspend, or terminate accounts; pause payments or withdrawals; cancel advertisements; remove listings; preserve evidence; and report matters to competent authorities. Severe child-safety threats or illegal content may be acted on immediately. We aim to review reports fairly, but we do not guarantee that all objectionable content will be detected before exposure. Where available, you may request review through the Help Center.
7. Messaging and interactions
Messages, story replies, comments, mentions, and shared posts are user communications. Do not send passwords, one-time codes, payment-card data, passport copies, or other unnecessary sensitive information in chat. Unless the Service expressly states otherwise, Foubeez messages are not end-to-end encrypted and must be processed and stored on our servers to deliver, synchronize, secure, and investigate reported abuse.
8. Marketplace
The marketplace lets independent users list and buy physical products. Unless a listing expressly identifies Foubeez as the seller, the seller—not Foubeez—is responsible for the product, legality, accuracy, quality, ownership, stock, price, taxes, warranties, shipping, returns, refunds, and customer support. Buyers must provide accurate delivery information and inspect listing details before ordering. Sellers must use truthful images and descriptions, disclose condition and defects, fulfil accepted orders, protect buyer information, and comply with consumer, product-safety, tax, import, export, and distance-selling laws.
Foubeez may review or remove listings, hold funds during a dispute, adjust an order, facilitate a refund, or restrict a seller, but is not a party to the underlying sale unless required by law. Prohibited marketplace items include illegal or stolen goods, weapons and regulated items where prohibited, drugs, counterfeit products, hazardous items, live exploitation, personal data, financial accounts, and any item disallowed by our policies or a payment provider.
9. Wallet, transfers, withdrawals, and platform fees
The Foubeez wallet is a closed-loop service ledger used for supported purchases, advertising, transfers, seller proceeds, refunds, and withdrawals. It is not a bank account, savings product, deposit, investment, or cryptocurrency, and no interest is paid. Availability, limits, currencies, verification thresholds, fees, withdrawal methods, and transfer features may be changed or disabled from time to time.
You may use only funds you are authorized to use. We may delay, reverse, freeze, or investigate a transaction to correct an error, prevent a negative balance, respond to a chargeback or refund, enforce limits, investigate fraud, comply with law, or protect users. Transfers sent to the confirmed recipient may be irreversible. Marketplace proceeds may become available only after the order reaches the required status. Platform commissions are calculated on the amount actually paid after discounts unless the checkout states otherwise. The applicable amount, commission, seller net, and order reference are shown in transaction records. Withdrawal approval does not guarantee that an external provider will complete payment.
10. Stripe, PayPal, app stores, and other payment providers
Supported payments may be processed by Stripe, PayPal, Apple, Google, banks, or other providers. Their terms, privacy policies, eligibility rules, disputes, refunds, and fees also apply. Foubeez does not store complete payment-card numbers entered on a provider-hosted checkout. A payment is complete only after reliable server confirmation; a screenshot, redirect, or client message is not proof of payment. We may disable a provider that is unavailable, unconfigured, restricted by an app-store rule, or unsafe.
11. Paid advertising
Advertisers must have authority to promote the selected content and destination. Advertisements must be accurate, clearly identifiable, suitable for the selected audience, and compliant with advertising, consumer, election, financial, health, and sector-specific laws. Approval is separate from payment and does not imply endorsement. Foubeez may reject, pause, limit, or remove a campaign, invalidate fraudulent impressions or clicks, and issue or deny refunds according to campaign status, delivery, payment-provider rules, and applicable law.
12. Verification badges
A verification badge indicates that Foubeez reviewed specified information at a point in time. It is not an endorsement, guarantee of identity for every purpose, professional licence, credit assessment, or guarantee that the account or its content is safe. Submitted verification documents must be genuine and belong to the applicant or represented organization.
13. Intellectual-property complaints
Respect intellectual-property rights. A rights holder may report allegedly infringing content with identification of the work, the challenged material, contact information, a good-faith statement, and evidence of authority. We may remove material and restrict repeat infringers. False or abusive notices may lead to account action and legal responsibility.
14. Service changes, availability, and third-party links
Features may be added, changed, suspended, limited by country or device, or discontinued. We do not guarantee uninterrupted operation, permanent storage, a particular reach, sales volume, advertising result, or compatibility with every device. Keep your own copy of important content and records. Third-party websites, products, sellers, and services are controlled by their operators, and Foubeez is not responsible for them.
15. Account closure and deletion
You may stop using the Service and request account deletion from Settings. A web deletion request is also available from the public Account Deletion page on the Foubeez website. Deletion removes or de-identifies account data and User Content from active systems, subject to a reasonable processing period and lawful exceptions. Transaction ledgers, tax records, fraud and security evidence, resolved reports, dispute records, and data required to establish or defend legal claims may be retained. Content sent to another person may remain in that person’s conversation record where required to preserve communication integrity and legal rights.
16. Disclaimers and limitation of liability
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” Foubeez disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Foubeez is not responsible for user conduct, User Content, independent sellers, products, delivery, external payment providers, lost profits, lost data, or indirect, incidental, special, consequential, or punitive damages. Nothing in these Terms excludes liability that cannot legally be excluded or limits mandatory consumer rights.
17. Your responsibility
You are responsible for losses, claims, and reasonable costs caused by your unlawful content, marketplace activity, payment misuse, infringement of another person’s rights, or material breach of these Terms, to the extent permitted by law.
18. Changes and applicable law
We may update these Terms for new features, legal requirements, security, or operational changes. Material changes will be announced in the Service or by another reasonable method, and the updated date will change. Continued use after the effective date means acceptance where permitted; if consent is legally required, we will request it. Mandatory consumer and privacy protections in your country remain unaffected. Other disputes are governed by the law and competent courts applicable to the Foubeez operator, unless mandatory local law provides otherwise.
